This is the case in which the Supreme Court, in a majority judgment, voided and set aside the decisions of the Federal High Court and the Court of Appeal, which had affirmed Bashir Sheriff Machina as the APC candidate from the party’s primary election held on May 28, 2022 and affirmed the candidature of the Senate President, Ahmed Lawan.

Delivering the majority judgment of the Apex Court, Justice Centus Chima Nweze held that Machina ought to have commenced his case at the Federal High Court with a writ of summons given the grievous allegations in his suit against the defendants. The apex Court set aside the decisions of the earlier courts.
The case was presided over by Justices Chima Centus Nweze, Mohammed Lawal Garba, Helen Moronkeji Ogunwumiju, Adamu Jauro, and Emmanuel Akomaye Agim.
