Corporate Affairs Commence (CAC) is in-charge of registration of business, creation of lawful entities. CAC does not allow non registered and accredited agents to access their services and register incorporated trustees, except where such unaccredited person seeking to register an incorporated trustee is a member of the board of incorporated trustees that he/she seeks to register. There is need for accreditation number of accredited agent seeking to register an incorporated trustee, this makes it hard and often impossible for non-accredited persons and touts to commence and complete the process of registration. Most non-accredited persons end up engaging accredited agent of CAC to continue and complete the entire process. Besides, the processes, constitution and minutes needed for the exercise are often specialised and need the services of a lawyer-Notary Public to certify. The Portal of CAC requires accreditation numbers of its accredited agents. By the way, a non-lawyer and non-accredited agent will not be able to defend any resulting legal action in the process of objections to process during the 28days newspaper notice.
It is a criminal offence for a non-lawyer to prepare documents where such may be used in court.
