Manufacturing or Selling of Fertilizer without Approval is a Crime.
Fertiliser is a government controlled commodity in Nigeria. The Federal Government determines who manufactures, blends, imports, sells, distributes, transports and keeps custody of fertiliser as well as selling points in Nigeria.
Fertilizer is defined by the National Fertilizer Quality (Control) Act 2019 to include “an organic and inorganic substances and mixture of substances containing one or more recognizable plant nutrient that is issued to improve plant nutrient content and is designed for use in promoting plant growth”.

It is a crime for any person to deal on fertiliser, sell, distribute, convert, dump or transport fertiliser in any part of Nigeria without the written approval of the Minister of Agriculture. Any Director, employee or staff of a manufacturer, blender, importer or distributor that operates without an approval is deemed to have personally committed the same offence that his/her organization/employer commits, unless the person can prove ignorance of the facts of the offence.

The punishment for any person that manufactures, blends, or imports fertilizer without approval is a minimum fine of Five Million Naira (N5,000,000.00) and a maximum of Ten Million Naira (N10,000,000.00). If the offender is a distributor of fertilizer without approval, the punishment is a fine of a Five Hundred Thousand Naira (N500,000.00) for each day that the offence continues.
