The Federal Competition and Consumer Protection Act (FCCPA), 2018 is Nigeria’s primary legislation on competition regulation and consumer protection. The Act was enacted as Act No. 1 of 2018 and commenced operation on 30 January 2019. The Act repealed the Consumer Protection Council Act and established the Federal Competition and Consumer Protection Commission (FCCPC) and the Competition and Consumer Protection Tribunal. The Act provides a comprehensive framework for promoting fair competition, preventing anti-competitive practices, and safeguarding consumer rights in Nigeria. It contains 166 sections and a Schedule.

The principal objectives of the Act are to promote and maintain competitive markets, enhance economic efficiency, protect consumers by ensuring access to quality goods and services at competitive prices, prohibit restrictive and unfair business practices, prevent abuse of dominant market positions, and contribute to the sustainable development of the Nigerian economy. The Act applies broadly to commercial activities within Nigeria and, in certain circumstances, to conduct occurring outside Nigeria that has effects within the country.

The FCCPA establishes a modern regulatory regime governing mergers and acquisitions, monopolies, restrictive agreements, price regulation, abuse of dominance, and consumer rights. It empowers the FCCPC to investigate anti-competitive conduct, enforce consumer protection standards, review mergers, and impose sanctions where necessary. By fostering fair competition and protecting consumers from exploitative business practices, the Act serves as a cornerstone of Nigeria’s market regulation framework and plays a crucial role in promoting consumer welfare, innovation, and economic growth.
