The Federal High Court (Pre-Election) Practice Directions, 2026 were issued to regulate the practice and procedure applicable to pre-election matters commenced before the Federal High Court. The Practice Directions supplement the provisions of the Constitution of the Federal Republic of Nigeria, the Electoral Act, 2022, the Federal High Court Act, and the Federal High Court (Civil Procedure) Rules by providing a specialised procedural framework for the expeditious hearing and determination of pre-election disputes. They govern matters relating to the commencement of actions, filing and service of processes, case management, interlocutory applications, hearing, delivery of judgments, and other procedural issues arising in pre-election litigation.

The Practice Directions were issued by the Honourable Chief Judge of the Federal High Court in 2026 pursuant to the powers conferred by section 254 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the Federal High Court Act, and other enabling laws. They came into force on the date specified in the Practice Directions and apply to all pre-election matters filed before the Federal High Court from that date.

The Practice Directions comprise a series of procedural rules governing the management of pre-election cases from commencement to final determination. They provide detailed guidance on electronic filing and service of court processes, assignment of cases, timelines for filing pleadings and applications, case scheduling, virtual proceedings where appropriate, accelerated hearing of pre-election matters, and the efficient management of proceedings in order to ensure compliance with the constitutional timelines for determining electoral disputes.

The principal objectives of the Practice Directions are to ensure the speedy and efficient disposal of pre-election cases, promote uniformity and certainty in the conduct of pre-election proceedings before the Federal High Court, strengthen effective judicial case management, minimise delays in electoral litigation, encourage the use of technology in court proceedings where appropriate, and ensure that all pre-election disputes are determined within the constitutional and statutory timelines prescribed under Nigerian electoral law.
