Registration and operation of companies in Nigeria are regulated by the Corporate Affairs Commission (CAC). The law is clear on whether private and public companies must have secretaries.
By law, any company in Nigeria must have a registered company secretary. This applies to all types, sizes and kinds of companies in Nigeria. The detail of such company secretary must be filed at the Corporate Affairs Commission. As expected, companies are allowed to change their secretaries.
My authorities are sections 293, 596 and 613 of the Companies and Allied Matters Act, 1990.
