The Federal High Court sitting in Abuja on the 8th of March 2022 delivered a judgement removing Governor David Umahi of Ebonyi State and the Deputy for leaving their political party. PDP V. INEC, APC, David Umahi & Anor

The trial Court judge based his decision on the fact that the votes that brought the Governor and his Deputy to power were votes of PDP and not personal votes of the duo, and therefore the duo were not capable of transferring the votes to APC upon their defection from the party.

The learned trial Judge held inter alia that the 393, 042 votes polled by Umahi on March 9, 2019 gubernatorial election were for the PDP and cannot be legally transferred to the APC upon defection and that there is no constitutional provision that made the ballot transferable from one party to another. He, therefore, ordered INEC to conduct fresh elections by section 177(c) of the Constitution.

This judgment is now an issue of judicial and political debate, inciting reactions from all quarters of the country and arousing the anxiety of the people on what could have informed the court to give such a decision.
