The President V. National Assembly, Speaker, Rivers Sate Assembly, and AG Rivers State (who joined through the order of the Court on 19th May, 2022). The judgment for the case was delivered on the 24th day of June, 2022.

In this case with suit no: SC/CV/504/2022, filed on April 29, 2022, President Mohammadu Buhari and the AG of the Federal Republic of Nigeria, Abubakar Malami, SAN sought the order of the apex court to strike out the section of the Electoral Act, which they argued was inconsistent with the nation’s constitution.

The seven-member bench of the Apex Court, led by Musa Dattijo-Muhammad, JSC, unanimously struck out the suit, describing it as an abuse of court process.

Justice Aokmaye Agim, JSC, who delivered the lead judgement, held that the president, having earlier assented to section 84 (12) of the Electoral Act 2022, cannot turn around to approach the court to strike it down.

“There is no provision in the constitution that vests the president the power to challenge the constitutionality or desirability of a legislation after he has assented or denied his assent. In this case, the president gave his assent,” Justice Agim, JSC ruled.

This matter had earlier been at the Court of Appeal where it set aside the decision of the Federal High Court Nullifying the said section.  Find the links below:
