In the case of Andy Solomon & Anor Vs. Goodluck Jonathan & 2 Ors, an Originating Summons dated 16th May, 2022 and filed on the 17th day of May, 2022, Andy Solomon and Idibiye Abraham , had asked the court to stop Jonathan from running for president, citing Section 137, (1b) and (3) of the 1999 Constitution.

The Section specifically states that a person cannot take an oath for the office of President more than twice, whether elected or constitutionally appointed to complete the term of a president.

The case that had All Progressives Congress (APC) and Independent National Electoral Commission (INEC) as 2nd and 3rd Defendants respectively was also intended to ask APC and INEC to disqualify Dr. Goodluck Ebele Jonathan to discredit him for the coming elections.

Ruling in Andy Solomon & Anor Vs. Goodluck Jonathan & 2 Ors, Justice Dashen held that the plaintiff’s claim, which was based on the adoption of Section 137 subsection 1b and 3 into the constitution in 2018, cannot be used retroactively to question Jonathan’s eligibility to run for president in 2023. Jonathan‘s right to run for president again, he added, cannot be thwarted by any retroactive legislation.
