On Whether APC And LP Are Right In Law/ Can They Validly, Later Substitute Their Nominated VP Candidates?
By E.C Nwuba, Esq

The answer is “YES” Forget about the name used by both political parties (standing-in or standing for someone). In law those gentlemen “standing-in” as VP candidates were validly nominated.

Generally they can’t be substituted except on two conditions. The law states;

33. A political party shall not be allowed to change or substitute its candidate whose name has been submitted under section 29 of this Act, EXCEPT

1) IN THE CASE OF DEATH or

2) WITHDRAWAL BY THE CANDIDATE;
Provided that in the case of such withdrawal or death of a candidate, the political party affected shall, within 14 days of the occurrence of the event, hold a fresh primary election to produce and submit a fresh candidate to the Commission for the election concerned.

Whence if those occupying the VP position can validly tender their withdrawal then the political parties can validly SUBSTITUTE them with another persons.
