Illegal Deployment and Public Defiance of Authority

ABUSE OF POWER; ILLEGAL DEPLOYMENT AND PUBLIC DEFIANCE OF AUTHORITY

Earlier in the week, News reports greeted us with the public defiance of authority. This was evidently carried out by Chief Superintendent of Police, Who retorted to the Governor with the phrase “I am here on the instruction of the Inspector-General of Police through the AGF. I am too small or too low to call them. Your Excellency sir, you can call them sir.”. This was a response to the Governor of Lagos State instructions, Babajide Sanwo Olu’s orders to leave the Magodo Estate premises as they have no business being there.
Recall that there is an ongoing land matter between the state government and private individuals of the Magodo Estate.
WHO CRIED FOUL FIRST?
Did to the ongoing land matter between the State government and private individuals of the Magodo Estate, there was a subsisting court order and the police were sent to execute such order. The Governor was supposed to have stopped this action through a Stay of Execution which would be gotten through the court process and the Inspector General of Police.
IF THE GOVERNOR IS THE CHIEF EXECUTIVE OF A STATE, AND IN THE CURRENT CIRCUMSTANCES IN THE STATE, WHO DOES THE POLICE ANSWER TO?
This now brings us to the important issues that have arisen in the recent incidents. S.176(2) provides that the Governor of a State shall be the Chief Executive of that State. This means that He/She governs all the affairs of a State. And flowing from that, he is a Authority that must be respected and instructions followed for the good of the Society. However, in this present scenario, the Powe tussle is between the Federal and State Government and due to the hierarchy that exists, the Federal Government order supersedes that of the State.
Also worthy of note is the fact that the Court Order gotten was by the Federal Government and it was under such order that the Chief Superintendent of Police acted upon and also why he referred the Governor to call those above. The response of the Chief Superintendent is not unfounded and can not be seen to be a defiance of Authority.
