It is common to find employers requesting their workers to undergo medical examinations. Is this legal and if it is legal, who should pay for such test? If medical tests and reports are personal, why should employers request workers to be medically examined? Can a worker choose not to be examined?

Workers, employers and employment contracts/affairs are governed by federal laws including the Labour Act. Clearly, the law requires every worker that enters into an employment agreement to be medically examined by a registered medical practitioner. Furthermore, such medical examinations are to be paid for by employers and not be workers.

This position extends to workers serving outside Nigeria and they must be examined in Nigeria at their last place of departure unless the Minister of Labour permits otherwise.

Clearly, medically examination of workers is provided by law and as such workers cannot complain and choose to be exempted. The above mentioned law applies across all parts of Nigeria.
